DMCA & Copyright Policy
Alex Doyle Guitar 😈 respects the intellectual property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and equivalent UK and EU frameworks.
Reporting Infringement
If you believe that content uploaded to Alex Doyle Guitar 😈 infringes a copyright you own or control, please send a written notice to our designated agent at [email protected] containing:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by a single notice.
- Identification of the material that is claimed to be infringing, with enough detail for us to locate it (a direct URL is best).
- Contact information for the complaining party: name, postal address, telephone number, and email address.
- A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorised to act on behalf of the copyright owner.
What Happens Next
On receiving a compliant notice we will remove or disable access to the material without undue delay and notify the user who uploaded it. Incomplete notices may delay our response.
Counter-Notification
If you believe your content was removed in error you may submit a counter-notice to the same address. A valid counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the appropriate court and will accept service of process from the person who submitted the original notice.
Repeat Infringers
We will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. A repeat infringer is a user whose content has been the subject of multiple valid takedown notices, or who has otherwise repeatedly uploaded material that infringes the rights of others.
Uploads & Rights Confirmation
Users uploading audio (including backing tracks) must confirm that they have the necessary rights to share that content before the upload completes. Misrepresenting ownership of copyrighted material may result in account termination and may expose the uploader to liability.
Misrepresentation
Knowingly submitting a false notice of infringement, or a false counter-notice, can result in liability for damages under Section 512(f) of the DMCA and equivalent provisions of UK and EU law. Please consult with a lawyer before submitting a notice if you are unsure.
